Frequently Asked Questions

Q: Is there a preference regarding gender in the Minnesota Statutes?

A: No. However, traditional biases and prejudices regarding parental roles do come into play, warrantingmore aggressive representation from the father's side.

Q: How is child support calculated?

A: A child support obligation is calculated according to Minnesota Child Support Guidelines, and the Courts generally accept that these guidelines are a rebuttable presumption. We have, however, argued many cases in which we convinced the Court to deviate from the guidelines.

Q: Does adjudication of paternity grant custodial rights?

A: No. A custody order is required for newly adjudicated fathers.
